依勞基法第82條與勞保條例第73條，皆規定：「……仍不繳納者，移送法院強制執行。」 由於社會法在不同層面上兼有公法與私法之特性，所以法條上說是法院，到底是依民事訴 訟法還是行政執行法辦理？ 另外，本來也有疑惑的現行消保法第62條(依法移送強制執行)，在看了消保法部分條文修 正草案刪除該條之說明：「行政執行相關事項依行政執行法規定為，爰予刪除。」之後， 更另人疑惑勞基法和勞保法是否也是尚未修法的關係，所以用語不是很明確。 不知現行實務上，是否已皆由行政執行分署執行？ -- ※ 發信站: 批踢踢實業坊(ptt.cc), 來自: 118.161.200.193 ※ 文章網址: https://www.ptt.cc/bbs/Examination/M.1421326127.A.63B.html
