立院三讀放寬民代解職條件

立法院院會今天三讀修正通過地方制度法部分條文，未來地方民意代表、地方民選行政首長受有期徒刑以上之刑判決確定，經檢察官同意得易服社會勞動者，不需解職。

現行法規定，直轄市議員、直轄市長、鄉鎮市民意代表、鄉鎮市長及村里長若受有期徒刑以上之刑判決確定，而未受緩刑宣告、未執行易科罰金者，應解除職務。

考量易科罰金和易服社會勞動立法目的具相同性質，三讀修正通過條文增訂，直轄市議員、直轄市長、鄉鎮市民意代表、鄉鎮市長及村里長若受有期徒刑以上之刑判決確定，不得易服社會勞動者，應解除職務。
