公民組合申請登記 遭內政部兩度駁回

律師林峰正等人籌組「公民組合」，以民進黨前主席林義雄為精神領袖。公民組合日前向內政部申請登記，卻被要求名稱要冠上「中華民國」或「台灣」，兩度遭到駁回。公民組合質疑，「人民團體法哪一條有這個規定？」

公民組合今天在臉書上公布2份內政部的回函公文，內政部表示，團體名稱應冠上「中華民國」、「中華」或「台灣」，以辨明主管機關及行政組織區域，也要加上「會」、「社」、「學會」、「學社」、「研究會」、「研究社」、「協會」、「協進會」等文字。

林峰正受訪時說，集會結社是人民的權利，申請登記則是依人團法進行，只要名稱並非違反善良風俗，為什麼不可登記為「公民組合」？他們將持續向內政部申請，不會更改名稱。

林峰正說，大法官會議釋字479號解釋文就曾指出內政部此作法違憲，若內政部還要刁難，他們會直接提出行政訴訟反擊。
