低頭撿手機電池 小客車駕駛撞死人

林姓男子去年3月25日開車行經台北市中正路時，因手機電池掉落腳踏板，他低頭撿拾，轎車因而右偏，撞上一旁的汽車維修廠周姓老闆與謝姓顧客；謝送醫不治，周脛骨、腓骨開放性骨折。士林地方法院依過失致死罪判林有期徒刑1年6月。

謝姓死者當時請周姓老闆修理客貨車，周坐在駕駛座上，雙腳伸出門外，詎料兩人遭林的轎車撞擊。

林姓男子（46歲）在停車場當管理員，事後承諾賠償周30萬元，獲周原諒；但他僅賠償謝姓死者家屬35萬元喪葬費，被害人家屬不滿。林說，他月薪2萬5千元，還要獨力撫養小孩，經濟上有困難。
