在讀稅務法規中的奢侈稅不甚了解的地方 奢侈稅第4條中規定: 第二條第一項第二款至第六款規定之特種貨物及特種勞務 其特種貨物及勞務稅之納稅義務人及課徵時點如下 一.產製特種貨物者,為產製廠商,於出廠時課徵 二......... 三.法院及其他機關拍賣或變賣尚未完稅之特種貨物者,為拍定人買受人或承受人 於拍賣或變賣時課徵 奢侈稅第十六條中規定 一.進口特種貨物者,納稅義務人為收貨人題或單或貨物持有人, 申報繳納時點為進口時由海關代徵 二.法院及其他機關拍賣或變賣尚未完稅之特種貨物者, 納稅義務人為拍定人買受人或承受人,申報繳納時點為提領前 想問各位高手的是 為何依照第四條的課徵時點課徵後 仍需要申報繳納 課徵後又申報繳納是否會造成重複課稅 還是其實兩法條是在規定不同的東西?
