標題[問題] 請問軍事審判法的適用

我的問題是 在軍事審判法修法後 目前只要在承平之時 現役軍人犯罪 依據軍事審判法第1條第2項規定 程序上就是依據刑事訴訟法 實體上則是依其所犯之罪為陸海空軍刑法或刑法分別論罪科刑嗎？ --------------------------------------------------------------------- 那如果戰時則是依軍事審判法第1條第1項以及軍事審判法第5條加以適用嗎？ 這樣的理解不知對不對，懇請各位前輩協助，感恩。 -- ※ 發信站: 批踢踢實業坊(ptt.cc), 來自: 1.167.68.40 ※ 文章網址: http://www.ptt.cc/bbs/Examination/M.1401620308.A.432.html
