高先生於102年2月1日出售新北台北土地一筆， 面積20公畝，每公畝公告現值為80萬元， 該土地購買於92年，當時移轉申報現值為30萬元，消費者物價指數上漲20%, 且高先生於96年支付重劃費用100萬。 設該土地為都市用地且符合自用住宅規定，計算土增稅。 解答是： 1.計算自用住宅三公畝部分每公畝土地漲價數額： 80萬-30萬*1.2=44萬 2.自用住宅部分土增稅=44萬*3公畝*10%=13.2萬 3.計算超出三公畝部分土地漲價數額： 44萬*17公畝-100萬重劃費用=648萬 4.初次移轉現值： 17公畝*30萬*120%=612萬 5.非自用住宅土增稅= 612萬*20%+(648萬-612萬)*30%=146.4萬 我的問題是， 為何土地重劃費用自用住宅的漲價總數額不用分攤， 反而是在非自用住宅的地方一次扣？？ 如果是我的想法 自用住宅每公畝漲價數額應該是80萬-30萬*1.2-100萬/20公畝=39萬 想問在這種狀況解答這樣計算的法源在哪？？ 找了相關規定找好久還是不得其解，謝謝版上大家。 -- ※ 發信站: 批踢踢實業坊(ptt.cc), 來自: 118.161.98.183 ※ 文章網址: http://www.ptt.cc/bbs/Examination/M.1408371723.A.64B.html ※ 編輯: mai0064 (118.161.98.183), 08/18/2014 22:22:52 ※ 編輯: mai0064 (118.161.98.183), 08/18/2014 22:23:11
