現狀: 我名下登記只有一間透天A，自住，買了將近一年。 我太太在外縣市因繼承過去就持分一棟B透天1/3(只持有7.26坪 ，該房子只有一樓有登記，二三樓後來加蓋沒有登記)，另外也繼承一點點土地與田 除此之外我配偶沒有其他的房子了。 我與配偶戶籍都在我這間A透天，也確實自住在裡面，但預計過一陣子要賣。 為了避免被課奢侈稅 首先要將我太太持分B透天1/3的部份贈與給我太太的妹妹。 原本我太太要贈與給她妹妹的部份包含B透天房屋與該房屋的土地， 但因為當初透天的起造人(我的岳父母)都過世了，相關資料找不到 到國稅局與地政事務所都無法確定該房屋座落在哪一筆地號的建地上 如果我太太只贈與房屋部分，而不去贈與該房屋的土地部分 問題一： 這樣一來是不是只有契稅與贈與稅(贈與稅為0)的部份， 免繳土地增值稅???? 問題二： 若這樣做當我賣透天A的時候會不會被課奢侈稅呢???? 在此感謝大家幫忙 -- ※ 發信站: 批踢踢實業坊(ptt.cc), 來自: 115.82.225.246 ※ 文章網址: http://www.ptt.cc/bbs/home-sale/M.1404642112.A.B5F.html
