除非你拍的是像是內褲、內衣…之類的影像，才會有妨害秘密罪的問題

簡單來講，對方遮著沒讓人看的部份，你就不能拍，不管你是不是在公共場所拍的。如果沒遮住的地方，拍無妨，像是臉、身材、大腿…之類的，就不會有刑法的問題

當然如果你拍的不是內褲、內衣…這些地方，而對方要求你刪除，你就刪除，你不會有犯罪的疑慮

如果你拍的是內褲…這些，不管你有沒有刪除，你都犯了罪
