乙為鞋店老闆，有天乙向好友甲抱怨，有雙名貴的球鞋昨天不見了 乙認為是丙偷的，剛好此時丙進入店內，甲將丙抓住並質問長達兩小時 但事實上球鞋仍在倉庫內，並未被竊。 請問甲是否為間接禁止錯誤？ 江敦育老師講義裡寫的是： 1.非容許構成要件錯誤，因為即使丙昨天有偷鞋，也非"現在"不法， 甲不得主張正當防衛，故非容許構成要件錯誤。 2.這是間接禁止錯誤，甲誤認有阻卻違法事由存在。 我的想法： 第1點我懂，但第2點我有疑問。 我以為"間接禁止錯誤"是對「法律上」阻卻違法事由的誤解， 例如對阻卻違法的創設和擴張。 但本題中的甲，是對「事實上」阻卻違法事實的認知錯誤(以為丙是小偷)， 對「法律上」阻卻違法的認識並無錯誤，請問為什麼會屬於間接禁止錯誤？ 感激不盡！ -- ※ 發信站: 批踢踢實業坊(ptt.cc), 來自: 125.230.120.129 ※ 文章網址: http://www.ptt.cc/bbs/Examination/M.1405521671.A.0AC.html
