第1項是客觀上有恐嚇且主觀上有取財的意圖第2項是客觀上有恐嚇也有取財成功我的疑問在於第3項第3項說:前二條之未遂犯罰之是不是指這兩種情況? 1. 恐嚇時未遂 2. 恐嚇既遂但是取財未遂(亦即取財失敗) 我的問題在於恐嚇要如何未遂? 雖然恐嚇本身不罰未遂但是本條之恐嚇跟305條的恐嚇畢竟不太一樣本條的恐嚇定義比較寬廣只要是讓人心生畏懼並且作為取財手段的任何手法都可以但是第3項規定第1、2項都罰未遂可是第1項要如何未遂? -- ※ 發信站: 批踢踢實業坊(ptt.cc), 來自: 140.119.171.143 ※ 文章網址: http://www.ptt.cc/bbs/Examination/M.1403598705.A.5B7.html
