Q1:甲一行為教唆乙殺AB二人，乙於10/11跟10/12各殺一人，請問甲的刑責 小弟的想法 甲成立兩個殺人罪之教唆犯，惟一個教唆行為，依55條想像競合，從一重處斷 Q2:甲教唆乙傷害A，乙"不小心"把A打死,請問甲如何論罪 參照林鈺雄老師的書，唯有教唆人對於加重結果有預見可能性時 始就加重結果部分負責，就加重結果犯而言，教唆人跟被教唆人無從屬關係 小弟的想法 有預見可能性時，甲成立過失致死罪之正犯? 無預見可能性時，甲成立傷害罪之教唆犯?
