請問共有物抵押分割實行的問題 我看李淑明書上一個案例 甲乙共有A地 甲應有部分設抵押權於丙 事後A地分割成甲有A1 乙有A2 解答是 因為868 分割不會影響丙之抵押權 丙施行抵押權拍賣時 若丁拍定 則A1由甲丁共有 A2由乙丁共有 因為乙喪失1/2所有權 所以乙可以向甲主張825 879之求償 為避免太過複雜 才增訂824-1 可是我之前看張台大跟宇法那邊的討論 主要是以釋字671那句話跟理由書的舉例 ========== 是強制執行時，係以轉載於分割後各宗土地經抵押之應有部分為其執行標的物。 於拍定後，因拍定人取得抵押權客體之應有部分 由拍定人與其他共有人，就該不動產全部回復共有關係 ========== 簡單來說 就是這次分割當沒有 沒有A1 A2 恢復成乙丙共有A地 請問是不是李淑明解錯了阿 還是我哪裡有誤會?? 感謝 -- -- ※ 發信站: 批踢踢實業坊(ptt.cc), 來自: 140.112.253.192 ※ 文章網址: http://www.ptt.cc/bbs/Examination/M.1400594457.A.A54.html
