甲教唆乙湮滅關係「乙自己的刑事證據」 討論：乙 165不成立 甲 第一個說法：乙仍有本罪不法，只是沒有期待可能性(S層面) 但甲因為從屬於165不法，仍成立165教唆犯 第二個說法：乙不成立165，甲依限制從屬性，也不成立165 學說好像比較偏第一說，實務好像比較偏第二說 請問：限制從屬性是從屬犯罪(TRS)還是僅從屬於不法呢(TR)? -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 114.40.55.141
