與男友性交觸法 小六女寫信求情

19歲國立大學男生在網路遊戲認識國小六年級女童，兩人交往一年多，去年12月中旬，兩人在女童家中發生性關係，被女童母親發現，報警送辦；女童寫信向法官求情，高雄地方法院判決男子因妨害性自主，處有期徒刑1年6個月，緩刑3年，並應接受法治教育3場，緩刑期間付保護管束。

判決書指出，這名學生現就讀國立大學，案發時和女童認識1年多。女童並告訴法官，「我深愛他，且一再約他來家中，是我要求與他發生性關係，不要因為此案影響他的前途」，向法官求情，請求從輕量刑。

判決書指出，雙方達成和解並賠償20萬元，表示不再追究，請求給予自新機會。

法官認為，男子與女童發生關係才19歲，因男女情愛一時衝動犯下犯行，且坦承犯行，深具悔意，考量男子因法紀觀念欠缺，導致衝動觸法，為使他在緩刑期間，保持良好品性，建立對兩性關係正確認識，導正偏差行為，緩刑期間接受3場的法治教育。
