很簡單，因為刑事訴訟法§233規定，被害人之法定代理人和『配偶』，得獨立告訴。而§234第四項補行告訴權人之規定，只是擴張了告訴權的行使主體範圍而已。

若犯刑法§298，被略誘人之配偶只要依照刑事訴訟法§233就可以提起告訴，自然不用在§234第四項多此一舉了。
