引言恕刪~ 以下是之前判例~ 最高法院69年台上字第3119號判例要旨：上訴人為從事汽車駕駛業務之人，既見對面有來車交會，而仍超車，於超車時，又未保持半公尺以上之安全間隔，竟緊靠右側路邊駛車，迫使在其右邊之林女駕駛之機車，無路行駛，一時慌急，操作不穩，緊急煞車，機車右前方裝置之後視鏡，碰到路邊之電桿而傾倒，致使機車後座林女之母摔倒地上，因傷斃命。是上訴人之違規行車，與林母之死亡，顯有相當因果關係，應負業務過失致人於死之罪責。現行車禍的過失責任在於「有無過失」及「因果關係」，不在於有無碰撞，那你就自己檢視是否有以上兩個條件，（1）是否有闖入車道（依描述你是支線）（2）他摔倒跟你是否有因果關係，如果有～2000不貴，如果沒有那你可以堅持1塊都不給。相信我的資料很多網站都可以找到，多上網翻翻，可以找到很多 -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 1.34.121.95
