有關行政處分廢止之敘述，下列何者正確？ (A)授予相對人利益之行政處分，行政機關原則上得隨時廢止 (B)行政機關廢止非授予利益之行政處分，應給予相對人損失補償 (C)行政處分經廢止後，原則上溯及既往至行政處分作成時失其效力 (D)行政處分經廢止後，處分相對人應返還不當受領之給付 答案是(D) 但根據行政程序法第125條但書以及第127條，不是要有「溯及既往失效之情形」時 ，受益人才應返還因該處分所受領之給付嗎？(D)選項並沒有敘明有這樣的情況？ 請問該怎麼解這題呢 > ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 111.243.245.25
