廣告不實以行為一罰原則開罰

食品藥物管理署表示，99年至102年7月，衛生機關裁處食品違規廣告案件計12,602件、罰鍰金額高達新臺幣43,108.4萬元，並可按次處罰直到停止刊播為止，即使屬同一產品的同一版廣告，若違規卻連續刊播，可按「一行為一罰」之原則開罰。

食品廣告若誇大不實、宣稱療效可依食品衛生管理法處以新臺幣4萬元以上20萬元以下罰鍰及新臺幣60萬元以上500萬元以下罰鍰。
