軍高院指出，懲罰法就是有規定違規可以悔過，問軍檢是有何法律依據認定違規不該悔過，要求補充說明。

軍檢說，軍檢立場就是極度保護被害人家屬。洪案律師李宣毅補充說明，非常感謝軍檢追查案件真相，傾出全力、火力全開，起訴之後也與我們建立平台，向家屬說明案情、於法依據。

李宣毅說，告訴人這邊與家屬是非常感激，本日庭間公訴人也是火力全開，告訴代理人謹表謝意。

李宣毅說，悔過的施行有法定要件程序，限制人民自由必須最高程序保障，長官要符合程序規則，才能施以悔過，但洪案的程序並不符合」，明知程序錯誤，仍施以悔過，不能因懲罰法有規定可施以悔過，長官明知有規定卻不按照程序來，剝奪人的自由。
