逃過禁令 蘋果繼續與三星鬥法

（中央社台北8日電）美國白宮上週罕見的否決蘋果在美國本土的禁售令，iPhone 4得以逃過一劫後，如今蘋果準備重整旗鼓，以迫使三星電子的行動裝置從美國商店下架。

據彭博報導，蘋果（Apple ）週五（9日）將要求美國上訴法院，阻止被加州陪審團裁定違反iPhone外觀與功能的三星電子公司（Samsung Electronics Co. ）智慧手機在美販售。之後，美國貿易機構將裁定是否根據其他蘋果的專利侵權主張，禁售三星部分進口產品。

對蘋果來說，迫使三星變更或停止販售部分智慧手機與平板電腦，比罰錢更重要。

去年美國法院裁定蘋果勝訴，三星須賠償10億美元。不過，這區區10億美元連iPhone二週銷售額都還不及，同時也僅是三星第2季獲利的1/7。

華府范載克公司（Van Dyke Firm）專職技術專利的律師范載克（Ray Van Dyke）表示：「有時候，光罰錢是不夠的。對蘋果與三星來說，這事關誰能讓對手屈服，以便稱王稱霸。」

蘋果與三星的出貨囊括全球智慧手機近半壁江山，三星雖奪下全球智慧手機龍頭寶座，但在美國市場則與蘋果爭坐頭把交椅。

蘋果與三星的專利殊死戰已延燒全球四大洲，雙方為了這場世紀官司投入了數百萬美元，但截至目前為止，沒有任何一方能夠給予對手致命的一擊。（譯者：中央社趙蔚蘭）1020808
