想問一下如果是在民國85年之前的違建(行政程序法90年1月1日施行) 按照行政程序法，違建5年不拆，所有被查報的違建，是因行政處分的時效消滅而就地合法嗎? 看法條是這樣寫沒錯 ========================== 行政程序法第131條：「公法上之請求權，除法律有特別規定外，因五年間不行使而消滅。公法上請求權，因時效完成而當然消滅。前項時效，因行政機關為實現該權利所作成之行政處分而中斷。」參照 ========================== 這樣子是代表這些違建就不能拆了嗎?感覺怪怪的,謝謝 -- ※ 發信站: 批踢踢實業坊(ptt.cc), 來自: 36.228.108.9 ※ 文章網址: http://www.ptt.cc/bbs/Examination/M.1418559665.A.3E5.html

推 sinksink: 不不，雖然有人這樣主張，但也有人主張公法上違法除去 12/14 20:24
