標題[問題] 車停紅線被酒駕的人撞爛

我家的車停在路邊紅線的地方 ((這邊我知道我方一定有過失而且會被開紅單)) 然後某天半夜被酒駕的迄投啊酒駕開的BMW撞爛 他撞了第一台準備肇逃但輪胎已撇所以又撞到我家的車 整個左側邊被撞凹 左後輪撞斷 整個車子也變形 他酒駕保險公司不賠 他來談的和解就是只要付我家這台十多年老車的殘值 然後再扣掉我方停紅線要自付3成責任 等於說他根本就不賠的意思 另一台他第一個撞的是3個月不到的新車 左後車輪被撞斷 車門變型 所以我們兩台被撞的一起提告 他高速衝過來推撞我們停在路邊的可以免責成這樣嗎? 雖然說對這種人還要傷神跑法院很累 但想請教各位大大上法院應該要怎麼主張對我方比較有利呢? 謝謝 -- ※ 發信站: 批踢踢實業坊(ptt.cc), 來自: 111.235.198.14 ※ 文章網址: http://www.ptt.cc/bbs/car/M.1409058986.A.77A.html
