時效不完成的解釋是在完成前因請求權無法行使或不便行使所給的緩衝期，但似乎有限制 在“時效完成前“才行(?) 因民法143條立意是怕礙於夫妻情面不提出請求，那假設，今天夫妻發生了侵權行為， 但由於夫妻情面加上可能有其他原因(例如以孩子監護權做要脅)導致未及時提出請求， 然後到消滅時效完成後才離婚，這樣還能保有時效不完成的權利嗎？ 究竟這時候應該講究時效不完成的定義(也就是必須是在時效完成前先離婚) 或者可以等"婚姻關係"這個妨礙事由消滅後再起算時效不完成呢？ 為了這個問題苦惱好久>※ 發信站: 批踢踢實業坊(ptt.cc), 來自: 42.79.150.226 ※ 文章網址: http://www.ptt.cc/bbs/Examination/M.1396432963.A.29E.html ※ 編輯: arumtree (42.79.150.226), 04/02/2014 18:20:26
