A公司為依組織規程設置之公營事業，於84年間，向高雄市政府申請挖掘道路埋設管線，經高雄市政府核准並發予「道路挖掘許可證」，並依行政院函釋，就A公司埋設管線之事實，免收土地使用費。嗣因高雄市政府於86年間訂定「高雄市市有土地裝置埋設管線計收使用費作業規則」，並經清查後，乃於100年10月11日發函，請A公司繳納自87年1月1日起之土地使用費。三）A公司如主張高雄市政府87年1月1日至95年12月31日之土地使用費請求權已罹於時效，是否有理由？試分別說明之為何自95/10/11~95/12/31的土地使用費還是可以追討(老師是說從100/10/11回溯五年) 不是行政法施行後殘餘期間超過5年者縮短為5年而已嗎(也就是95/1/1請求權就消滅了嗎) 回溯五年是怎麼來的呢? -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 36.232.101.59
