邱姓美容醫師已婚並與妻育2子，去年6月診所陳姓護士替他產下一子，4個月後邱醫又帶呂姓護士到韓國和台中出差，兩人同居。邱妻提告，但邱男以每月12萬元贍養費取得妻子對自己和呂女和解。法官審理後判陳女賠10萬元。

邱妻指控，陳女和丈夫產下一子，呂女和丈夫同居還藉出差為名相遊，對兩人提告，並分別求償100萬元和50萬元精神慰撫金。陳女認為，邱妻利用自己蒐集丈夫和呂女通姦的證據，且展現溫柔和關懷，關心她和孩子，應該有原諒之意。

呂女說，邱妻對她提告後，邱醫出面，雙方達成和解，邱醫每月支付醫生娘和孩子12萬元贍養費，邱妻撤告。

法官認為37歲的邱妻碩士畢業，每月可領12萬元贍養費，陳女僅高職畢業，還有一子須撫養，審酌兩人學經歷和財力後，判陳女賠邱妻10萬元精神慰撫金。呂女已與邱妻和解，邱妻不得對她求償。
