個人淺見 基本上這兩題似乎涉及正當防衛與第三人的問題 根據這個問題陳子平老師有寫過文章 大概分為兩說 甲說 此說認為行為人的反擊行為是發生在不相干的第三人 就可以認定該行為屬於迴避危難的行為人 因為解釋上可以認為施行正當防衛的行為人 主觀意思包含避難意思在內 因此雖然對第三人不能成立正當防衛 但可以依緊急避難阻卻違法性 (甘添貴老師和林鈺雄老師採此說) 乙說 此說認為正當防衛之行為人主觀意思不能包含避難意思在內 因此對第三人不能成立正當防衛亦不能認為有緊急避難之適用 惟並不能據此認定行為人即具備有責性而成立犯罪 應該綜合判斷行為人是否有故意或者過失 亦或是有合法行為的期待可能性 來判斷行為人是否具備有責性而成立犯罪 簡單的來說行為人並沒有阻卻違法事由 但是否有阻卻罪責事由應該個案判斷 (陳子平老師採此說) 因此在採甲說判斷上比較簡單基本上第一二題應該都成立緊急避難 若採乙說則須視個案而定就看如何說理比較圓融就是了 最後老師文章寫的比較清楚有興趣可以去閱讀 應該是寫在月旦法學教室那一期我忘記了=.= 可以用月旦法學知識庫找一下 -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 182.155.34.240 ※ 編輯: cherrywo 來自: 182.155.34.240 (10/01 02:42)
